What type of business should I be?

Default What type of business should I be?

I run a freelance design business, it's just me, out of my home. All checks are payable to my name. I'd like to make it an actual business so that my personal assests and business assets are seperate in case something should every go awry.

I'm reading the Pennsylvania business site on business structure (http://www.paopen4business.state.pa....p?a=3&q=440562) and I was wondering what type I really need to register for?

Right now I'm a Sole Proprietorship without a ficticious name. So I know I need the ficticious name no matter what. I think I either need to be a Corporation or a Limited Liability Company. What company structure am I? Please help, thanks.

Oh I should note that someday I'd like to get office space and a few employees but this is a very long-term goal. Right now I just want to get my home-based business going. Thanks.

talk to a cpa. they are the most knowledgable as to what you should register as and why. good luck!

I thought i'd share my structure with you.. although I'm in Washington State. I'm a graphic designer with my own business... we're an LLC.

i am an s-corp because my very trusted accountant said it woud be best considering the various facets/businesses i will open under this umbrella.

There are always ways for people to sue you and get your personal assets despite corporation or LLC protection. I would talk to a business lawyer about it, not just a CPA.

Is what you are doing have any chance of someone suing you? In all honesty, for a freelance designer, I can't see any chance of one.

I'll retract my statement if someone can link me to a court case

I recommend you talk with both a good CPA and Business Attorney. You need to consider the tax implications of the different types of businesses. Here is a good starter article Should I Incorporate.
