Default Selling other peoples cars?

I have an idea for an online business where I would sell other cars through ebay. I would basically charge a fee to take pictures of the car and write the ebay listing. Anybody have any ideas on the legalities of this? I know if I sell more than 5 I need a license but I technically would never have these cars in my name. I would just be a selling assistant. I also wouldn't really be selling on consignment as I would never have possesion of the vehicle. If anyone has done this or has any insight I would appreciate it. Thanks,

I beleive that there are a lot of people that do similar things in selling other peoples unwanted goods. I even beleive that there are shops in some palces that you can take something in and they will list it and all for you. So it isnt an antirly new idea, i just dont think people would have previously done this on a Car before. I could say if there is anything legally against it but i should not think so. But then i am in a different current and am not a lawyer.

In real estate, if your fee for helping a seller sell their home is based on a percentage of the selling price then you need a license. Selling cars, however, is evidently different because you don't need a license to work at a dealership even though your pay is based upon a percentage of the sale of the car.

I think it would be legally o.k. to help people market their cars as long as you bill yourself as a marketing consultant and not as a car broker.

BTW, I've had a similar idea but have yet to act on it.

Whose name would the ebay listing be in? If it is yours - sounds like you will get yourself into a heap of trouble. If it is theirs, then you should not have anything to worry about

Well, not sure about the eBay listing name. Not sure if the IRS will really care about that. I don't think it will matter because on the pink slips, it won't mention his name at all. I think point of contact is different than the seller.

I'm no expert though. -w

Well it matters to eBay. if I give you a car to sell - you are responsible for that car in the eyes of the buyer.
