Default She thinks I'm sub-contract

I work for this lady and she talks about me as a contractor...
I never signed anything or really knew that's what she considered me untill she just mentioned it. Isn't there paperwork for this to make it official? I just don't want to get screwed over during tax time. Also, everytime I mention it she changes the subject.

Are we really in a contractor realtionship vs. employee?
Or does she just not know what she's doing?

Also, if she reports me on her taxes as contracted work and I don't, what will happen?

Please help.

Are you getting a pay stub? If she's taking out fica, ssi, etc, you're an employee.

I agree with CaptShady - if she is just giving you $5,000 a month and not taking anything out, more than likely you are a contractor. But didn't you sign some type pf paperwork before taking this job?

No paystub, just a check each time. No paperwork was signed.

And what did you think you were? There should be paperwork signed to protect you and her. Pete said it - stop & talk to her. You might find yourself in a world of hurt come income tax time

Yeah, tell her it's time to talk - or your next stop is the wage and hour people. That should slow her down a bit.

I would have to agree to everyone here. You can find your self in a world of trouble if you don't take the 5 mins to talk to her. If she's changing the subject, change it back.

Yep. Sounds like she want syou to be a contractor so she has no obligation to pay any taxes, etc. Meanwhile you have an income that is not subject to withholdings. That could leave you with a huge tax bill. Among other problems.
